IP Australia announces free COVID-19 extensions

IP Australia has announced a streamlined process for extension-of-time requests to assist those impacted by the COVIID-19 outbreak. From 22 April 2020, those impacted by COVID-19 can obtain an extension-of-time of up to 3 months free of charge instead of the usual $100/month official fee… such fees are now waived or refunded. This applies to most Patent, Trade Marks and Designs requests, and relates to extensions-of-time for undertaking actions such as, but not limited to, requesting examination, obtaining acceptance, responding to Examiner’s reports, etc. Extensions-of-time are available for any delay which impacts Applicants/Owners, their Attorneys/Representatives, and, other ‘relevant persons’. Notably however, these streamlined extensions are not available for renewal/maintenance/continuation fees, although the 6 months grace period is available. Also, ordinary extensions-of-time remain available for periods longer than 3 months. This arrangement is temporary and is subject to regular review in consideration of the severity of the COVID-19 pandemic disruptions.
