12 month grace period proposed for Australian Designs

6 August 2020

IP Australia have released draft legislation proposing amendments to the Australian Designs Act.

The introduction of a 12 month grace period for designers to apply for Australian Registered Design protection after using or publishing their design is a notable inclusion in the draft legislation.

Whilst a 12 month grace period currently exists in respect of Australian Patents, at present there is no grace period for Designs.

Details of the legislation and other changes are available on the IP Australia website, noting that comments may be submitted by 28 August 2020....see Australian Designs Bill 2020.
