The first period of registration of an Australian Trade Mark is ten (10) years
from the application filing date. If the registration was based on a Divisional
Application, the first period of registration stems from the date of filing of the
original parent application. The registration can then be renewed for further
periods of ten (10) years.
Renewal applications should be made within the last twelve (12) months of the
registration term. If the renewal fee is not paid by the expiry date, application
for late renewal can be made during the twelve (12) months after expiry, upon payment of
additional fees.
No action for infringement can be taken in respect of acts done during the twelve month
grace period between the expiry of the registration period and the renewal of a
registration. |
