Australian registered designs have an initial term of twelve (12) months
commencing on the date of registration.
A request for the first extension of term must be filed within the initial term.
Late payment is not possible.
The first extended term expires on the sixth (6th) anniversary of the filing date of
the application for registration.
Where the application is a divisional application, the first extended term expires on
the sixth (6th) anniversary of the parent filing date, or the filing date of the first
application in the chain of preceding applications.
The registration is extendible for two further five (5) year terms, by making a request
before the sixth (6th) and eleventh (11th) anniversaries, making the maximum term of
registration sixteen (16) years from the date of filing, or the filing date of the first
application in the chain of preceding applications. A grace period of six (6) months
is available for the second and third requests for extension of term.
A fee is payable on requesting an extension of term, except for a "Subsequent
Registration" based on an application filed under Section 25D of the Act in respect
of an earlier design registered to the same proprietor(s) for which no request for
extension is necessary. The status of a design of addition is affected by the status
of its parent's registration.
A six (6) month grace period is provided for the payment of the second and subsequent
extension fees. |
